Under CrPC, summons are issued to accused persons, witnesses, and other persons whose presence is required. Summons specifies the date, time, and place of appearance. Failure to comply can result in warrant of arrest.
Bailable warrant (BW) — person can be released on furnishing bail bond. Non-bailable warrant (NBW) — person arrested and produced before court without option of bail by police. NBW is issued when accused fails to appear despite summons, when there is reasonable suspicion of absconding, or in serious offences.
On receiving summons, appear before court on specified date. If unable to appear, apply for exemption through lawyer. On arrest under warrant, contact lawyer immediately. For NBW, apply for recall/ cancellation before the issuing court. Show cause why warrant should not have been issued.
