Triple Talaq (instant talaq) was declared unconstitutional by the Supreme Court in 2018 and is now a criminal offence under the Muslim Women (Protection of Rights on Marriage) Act, 2019, punishable with 3 years imprisonment.
Talaq must be pronounced in accordance with the Quran — one pronouncement during the wife's period of purity (tuhr), followed by a 3-month waiting period (iddat). The husband must attempt reconciliation.
Khula is the right of the wife to seek divorce by returning the mahr (dower) or any other consideration to the husband. If the husband agrees, Khula is effective. If not, the wife can approach the court.
Under the 1986 Act, the husband must provide fair and reasonable provision and maintenance during the iddat period. After iddat, the wife can claim maintenance under Section 125 CrPC.
Under Muslim personal law, the mother is entitled to custody of sons until age 7 and daughters until puberty. However, the court prioritises the child's welfare.
Iddat is the waiting period after divorce during which the woman cannot remarry. It is 3 menstrual cycles or 3 lunar months for a divorced woman, and 4 months 10 days for a widow.
Talaq pronounced properly (not triple talaq) is valid without court intervention. However, Khula typically requires court involvement if the husband does not agree. Court registration is recommended.
Nikahnama (marriage certificate), proof of talaq pronouncement (if any), correspondence between parties, income proof, child birth certificates, and any prior maintenance orders.
