What is the Workmen's Compensation Act?

The Workmen's Compensation Act, 1923 (now known as the Employees' Compensation Act, 1923) provides for payment of compensation to workers who suffer injuries or death arising out of and in the course of employment. The Act is a social security legislation ensuring that workers and their dependents receive financial support when they are unable to work due to employment-related injuries.

Types of Injuries and Compensation

Death: Compensation equal to 50% of monthly wages Γ— relevant factor (based on age) or Rs. 1,20,000, whichever is more. The relevant factor ranges from 228.54 (age 16) to 99.37 (age 65+).

Permanent Total Disablement: Compensation equal to 60% of monthly wages Γ— relevant factor or Rs. 1,40,000, whichever is more.

Permanent Partial Disablement: Compensation is a percentage of the compensation for permanent total disablement, based on the percentage of disability as specified in Schedule I of the Act.

Temporary Disablement (Total or Partial): Compensation is 25% of monthly wages for the period of disablement, payable fortnightly. Maximum period is 5 years.

Claim Process under the Act

Step 1: The accident must be reported to the employer immediately. The employer must notify the Commissioner within 7 days of the accident (for death cases) or within 30 days (for other cases).

Step 2: The employer can settle the claim voluntarily by paying the compensation calculated as per the Act. If the employer disputes liability, the workman must file a claim before the Workmen's Compensation Commissioner.

Step 3: The Commissioner hears the case, examines evidence, and passes an order determining the compensation payable. The Commissioner can also award interest and penalty for delayed payment.

Step 4: If either party is aggrieved, they can appeal to the High Court within 60 days on substantial questions of law.

Documents Required for Compensation Claim

Medical records: injury report, treatment records, discharge summary, disability certificate. Employment records: appointment letter, wage slips, attendance records. Accident report: FIR (if applicable), accident report filed with employer. Proof of age: birth certificate, school certificate, or medical certificate. Identity proof: Aadhaar, voter ID, or any government ID.

Occupational Diseases Covered

The Act covers specific occupational diseases grouped under Schedule III. Group A includes diseases caused by exposure to toxic substances (lead, phosphorus, mercury, arsenic, etc.). Group B includes diseases in specific occupations (silicosis in mining, asbestosis, occupational dermatitis, etc.). Group C includes diseases in any occupation involving exposure to certain hazards.

If a workman contracts an occupational disease, it is presumed to have arisen out of and in the course of employment unless the employer proves otherwise.

Penalties for Non-Compliance

If the employer fails to pay compensation when due, the Commissioner can award: (1) interest at 12% per annum on the arrears, and (2) penalty up to 50% of the compensation amount. The employer can also be prosecuted for non-compliance with the Act.

Employers are required to insure their workmen's compensation liability. Failure to insure can result in the employer having to pay the compensation from their own funds along with penalties.
